General Terms and Conditions of Purchase
1. GENERAL TERMS AND CONDITIONS OF SALE
This document establishes the general terms and conditions governing the contractual relationship for the purchase and sale of products by individuals and/or legal entities who express their willingness to acquire the products and services offered by JULIA PROVENZA, S. L., Tax ID (CIF) B58569799, with registered office in Montgat (hereinafter, JULIA PROVENZA, S. L.), through a request made by electronic means, specifically via the Internet through the website www.ferdinandparts.com.
The commercial relationship between JULIA PROVENZA, S. L. and the customer shall be governed by the general terms and conditions set out herein, effective at the time the order is placed.
2. PRE-CONTRACTING INFORMATION AND USER ACCEPTANCE
These General Terms and Conditions of Sale are permanently displayed on the website owned by JULIA PROVENZA, S. L., allowing any user to be informed in advance of the price, characteristics, rights and, in general, all conditions under which the purchase will be carried out.
These General Terms and Conditions, together with the specific request submitted online by the USER, constitute the formalisation of the purchase contract between JULIA PROVENZA, S. L. and the USER, who declares to be of legal age, to have sufficient legal capacity to contract, and to have read, understood, and accepted these conditions.
3. DOCUMENTATION AND INFORMATION AFTER CONTRACTING
At the time the contract is executed, and within no more than twenty-four hours except for justified causes of delay, JULIA PROVENZA, S. L. will send to the email address previously provided by the USER a confirmation of the contracted product, its cost, including a breakdown of applicable taxes, as well as shipping costs if borne by the USER.
4. RIGHTS, OBLIGATIONS AND RESPONSIBILITIES OF JULIA PROVENZA, S. L.
4.1. PRODUCT DELIVERY
JULIA PROVENZA, S. L. undertakes to deliver the product in perfect condition to the address provided by the USER in the order form. JULIA PROVENZA, S. L. shall not be held liable for errors in delivery caused by inaccurate or incomplete information provided by the USER in the order form.
The delivery period begins once JULIA PROVENZA, S. L. receives the order payment via POS to its virtual account.
JULIA PROVENZA, S. L. undertakes to dispatch the order as quickly as possible, with usual delivery times of 24–72 business hours from Monday to Friday from payment confirmation within mainland Spain, and 4–6 business days for the Balearic Islands. No shipments are made to the Canary Islands, Ceuta, or Melilla; users must contact ferdinandparts911@gmail.com for alternatives.
Delays in shipping do not imply the termination of the contract nor entitlement to compensation.
Each shipment includes an online invoice detailing the full contents of the order. To request a tax-deductible invoice, the USER must contact JULIA PROVENZA, S. L. via email at ferdinandparts911@gmail.com; billing details will be requested and the invoice sent promptly.
The recipient must verify that the components received match the order and invoice, and must ensure that the number of parcels delivered matches the number listed on the carrier’s delivery document.
Any issues regarding the received goods or their packaging must be recorded in the carrier’s delivery document and reported to JULIA PROVENZA, S. L. within 24 hours by email.
In case of order cancellation, the customer must cover all delivery and return costs.
All orders are shipped through a transport agency. If delivery is unsuccessful after two attempts, the package will be held at the nearest agency for 10 days. After this period, the shipment will be returned to JULIA PROVENZA, S. L.
4.2. LIABILITY OF JULIA PROVENZA, S. L.
JULIA PROVENZA, S. L. shall not be liable for:
Errors or delays in USER access when entering data into the order form, delays or failure in receiving order confirmation, or any anomalies caused by issues with the Internet network, force majeure, or other unforeseeable events beyond the company’s good faith.
Errors or damages caused by inefficient or improper use of the service by the USER.
Non-operability of the email address provided by the USER to receive order confirmation.
Presentation errors such as incorrect descriptions, colours, or any other display-related issues. USERS may request additional product information at ferdinandparts911@gmail.com.
Manufacturer-defined product warranties. The warranty does not cover defects or breakages due to misuse, impacts, tampering, or any deterioration. JULIA PROVENZA, S. L. accepts returns only when the product is defective or arrives in poor condition. See “Warranties, Returns and Withdrawal” for more information.
Modifications, updates, or interruptions of the website, its content, or access to it, carried out without prior notice.
The USER expressly waives any contractual or pre-contractual liability claims for damages arising from the aforementioned situations.
In any case, JULIA PROVENZA, S. L.’s liability shall be limited to refunding the amount paid for the products, provided that the USER returns the product in question.
5. RIGHTS, OBLIGATIONS AND RESPONSIBILITIES OF THE USER
5.1. PAYMENT
The USER agrees to pay in advance for the requested product under the following conditions:

The price shown on the website and in the USER’s order request will apply. All product prices include VAT.
Additional shipping costs will be added unless the shipment is free of charge, which will be clearly indicated.
Orders under 35€ include shipping costs, calculated depending on weight.
All prices are in Euros.

5.2. USER RESPONSIBILITY
The USER assumes all risks of deterioration, damage, or loss of products once they have been placed at their disposal by the delivery service acting on behalf of JULIA PROVENZA, S. L. Signing the delivery document constitutes acceptance of correct receipt.
The USER must check the condition of the product before signing the delivery document.
6. WARRANTIES, RETURNS AND WITHDRAWAL
Returns are subject to prior communication via email at ferdinandparts911@gmail.com.
The warranty applies only when the product is used under normal conditions as determined by the manufacturer. JULIA PROVENZA, S. L. is not liable for damages resulting from misuse, accidents, improper installation, third-party property damage, loss of profit, or deterioration.
Products are excluded from warranty when:
They have suffered external damage, accidents, improper handling, or electrical issues after delivery.
They have been modified or repaired by the USER.
JULIA PROVENZA, S. L. will only accept returns if:
The product has not been modified.
The USER exercises their right of withdrawal within 7 days, according to applicable regulations (Spanish Retail Trade Act and EU Directive 97/7/EC).
The product must be returned in its original packaging, unopened, in perfect condition, and including all components.
The USER bears all return costs (including original free-shipping costs, if applicable).The USER refuses delivery for reasons unrelated to JULIA PROVENZA, S. L.; the USER must pay shipping and return costs plus handling fees.
The wrong product was delivered, or it arrived damaged during transport.
The damage must be recorded on the carrier’s delivery document and reported within 8 hours.
If conditions are not met, JULIA PROVENZA, S. L. assumes no responsibility.
To request a return, the USER must send an email including:
Full name
Order number
Online invoice number
Contact phone
Reason for return
Any additional relevant information
Once received, the incident will be processed.
7. CONTRACT TERMINATION
Both JULIA PROVENZA, S. L. and the USER may terminate the contract under any grounds established by law, particularly for breach of these General Conditions.
8. INTELLECTUAL AND INDUSTRIAL PROPERTY – COPYRIGHT
All intellectual and industrial property rights relating to logos, emblems, photographs, texts, and other elements on this website belong to their respective owners. Any violation will result in the appropriate legal actions.
9. MODIFICATION OF THESE GENERAL TERMS OF CONTRACTING
These General Terms remain valid while published on the website. They apply only to products purchased while they are in force.
JULIA PROVENZA, S. L. reserves the right to modify these Terms to adapt them to legislative changes, case law, or industry practices, taking into account consumer rights at all times. Any modification does not affect purchases made prior to the changes.
10. LEGAL NOTICE – JURISDICTION AND APPLICABLE LAW
These General Terms are governed by Spanish law.
All disputes, claims, or controversies shall be resolved by the Courts and Tribunals of Lleida, and the USER expressly waives any other jurisdiction that may correspond.
If any clause is declared null, the remaining clauses shall remain valid.
Failure by JULIA PROVENZA, S. L. to enforce any rights herein shall not constitute a waiver unless expressly stated in writing.
